- CONTINUING EDUCATION. During the 24 months prior to the license renewal date, each licensed massage therapist must complete 16 hours of continuing education hours, 50% of which may be gained through on-line or electronic media. Continuing education activities and requirements are as follows:
008.01 MANDATORY HANDS-ON HOURS. A licensee must complete at least 8 hours of hands-on massage therapy continuing education through workshops each renewal period. One hour of attendance equals 1 hour of continuing education. A licensee may earn all 16 hours through hands-on workshops. These hours must meet the following requirements: (A) The content of the workshop must include at least 75% hands-on massage technique; up to 25% may be theory related to hands-on technique; and (B) The workshop must include a set period of time for class participation which is handson practice.
008.02 MANDATORY ETHICS HOURS. Each licensee must obtain at least 3 hours of continuing education relating to massage therapy ethics. Ethics hours may be taken through home study or other electronic media.
008.03 PRACTICAL EXAMINATION. 3 hours will be granted for a licensee who successfully completes a practical examination administered by a Nebraska licensed Massage Therapy School and these hours count towards the mandatory hands-on hours. 008.04 NON-HANDS ON HOURS. Up to 8 hours of non-hands on activities can be applied to the 16-hour requirement.
(A) LICENSURE EXAMINATION. 5 hours will be granted for licensees who successfully pass an approved licensure examination.
(B) PUBLICATION. 3 hours will be granted for authoring an article published in a professional health-related journal; a newsletter article or letter to the editor does not meet this requirement.
(C) JURISPRUDENCE EXAMINATION. 3 hours will be granted for licensees who receive a score of at least 75% on the jurisprudence examination.
(D) INSTRUCTOR AT A MASSAGE THERAPY SCHOOL. Instructors at a Nebraska massage therapy school will be granted 1 hour for each hour of teaching, up to 5 hours.
(E) MASSAGE SCHOOL TRAINING, COLLEGE OR UNIVERSITY COURSEWORK. Hours can be resident or distance learning. One hour of training equals 1 hour of continuing education; 1 semester college credit hour equals 15 hours of continuing education; or 1 quarter college credit equals 10 hours of continuing education. (F) HOME STUDY PROGRAMS OR OTHER ELECTRONIC MEDIA. Licensees can use up to 8 hours of homestudy programs to meet continuing education.
(G) PRESENTER CREDIT. A presenter at a continuing education course may receive the same credit hours as an attendee for only the initial presentation during a renewal period. 008.05 ACCEPTABLE TOPIC AREAS. Topic areas that are acceptable for continuing education activities are as follows: (A) HANDS-ON. The following are the acceptable topic areas: (i) Hydrotherapy. (ii) Massage. (B) NON HANDS-ON. The following are the acceptable topic areas: (i) Anatomy. (ii) Health service management. (iii) Hygiene. (iv) Pathology. (v) Physiology.

NAC 640C.100 Massage therapists and structural integration practitioners: Requirements to maintain license; proof of completion; request to carry over excess hours of credit; notice of noncompliance. (NRS 640C.320, 640C.500)
1. To maintain his or her licensure, a massage therapist or structural integration practitioner must complete, to the satisfaction of the Board, at least 24 hours of instruction in continuing education as specified in NAC 640C.110 or 640C.112, as applicable, within the licensing period immediately preceding the request for renewal of his or her license. Except as otherwise provided in subsection 2, proof of the completion of the requirement for continuing education must be submitted with an application for renewal of a license.
2. If a massage therapist or structural integration practitioner obtains more than 24 hours of instruction in continuing education in a licensing period, the massage therapist or structural integration practitioner may request that the Board carry over the excess hours of credit, not to exceed 72 hours of instruction, to apply towards completion of the requirement for continuing education set forth in subsection 1 for succeeding years, up to a maximum of 3 succeeding years.
3. If a massage therapist or structural integration practitioner fails to complete the requirements for continuing education set forth in subsection 1 before the date on which his or her license expires, the Board will send a notice to the massage therapist or structural integration practitioner indicating that the massage therapist or structural integration practitioner is not in compliance with the requirements for continuing education.

NAC 640C.110 Massage therapists: Approval of credits by Board. (NRS 640C.320, 640C.500)
1. The Board will approve credit for continuing education for a license to practice massage therapy as follows:
(a) One hour of credit will be approved for each hour of instruction that a massage therapist attends a workshop, course, conference or seminar relating to the practice of massage therapy which is provided by a person or entity that is:
(1) Accredited by the National Commission for Certifying Agencies, or an equivalent accrediting body approved or recognized by the Board;
(2) Approved by the National Certification Board for Therapeutic Massage and Bodywork;
(3) A massage therapy school, bodywork therapy school, public college, postsecondary institution or other entity which offers a program of massage therapy that is recognized by the Board pursuant to NRS 640C.400 and NAC 640C.060; or
(4) A massage therapist with at least 2 years of experience in the practice of massage therapy or a related field who has previously received approval from the Board for the workshop, course, conference or seminar.
(b) The amount of credit for authoring a publication relating to the practice of massage therapy will be determined upon receipt and evaluation by the Board of the information required to be submitted pursuant to NAC 640C.130.
(c) One hour of credit, up to a maximum of 16 hours of credit per renewal period for each activity listed in subparagraphs (1), (2) and (3), will be approved for each hour of instruction spent:
(1) Giving a presentation at a workshop, course, conference or seminar relating to the practice of massage therapy.
(2) Preparing a presentation described in subparagraph (1).
(3) Serving as a member of the Board or a member of a committee appointed by the Board or attending a meeting of the Board.
2. A massage therapist may receive credit only once for giving or preparing a presentation described in subparagraph (1) of paragraph (c) of subsection 1.
3. The Board will consider the written request of a massage therapist for approval of credit for any continuing education that is not specified in subsection 1, including credit for any continuing education that is not specifically related to massage therapy, if the request is submitted to the Board at least 90 days before the date on which the license of the massage therapist expires.

NAC 640C.112 Structural integration practitioners: Approval of credits by Board. (NRS 640C.320, 640C.500)
1. The Board will approve credit for continuing education for a license to practice structural integration as follows:
(a) One hour of credit will be approved for each hour of instruction that a structural integration practitioner attends a workshop, course, conference or seminar relating to the practice of structural integration which is provided by a person or entity that is:
(1) Accredited by the National Commission for Certifying Agencies, or an equivalent accrediting body approved or recognized by the Board;
(2) Approved by the International Association of Structural Integrators;
(3) A structural integration school, bodywork therapy school, public college, postsecondary institution or other entity which offers a program of structural integration that is recognized by the Board pursuant to NRS 640C.620 and NAC 640C.060; or
(4) A structural integration practitioner with at least 2 years of experience in the practice of structural integration or a related field who has previously received approval from the Board for the workshop, course, conference or seminar.
(b) The amount of credit for authoring a publication relating to the practice of structural integration will be determined upon receipt and evaluation by the Board of the information required to be submitted pursuant to NAC 640C.130.
(c) One hour of credit, up to a maximum of 16 hours of credit per renewal period for each activity listed in subparagraphs (1) to (4), inclusive, will be approved for each hour of instruction spent:
(1) Giving a presentation at a workshop, course, conference or seminar relating to the practice of structural integration.
(2) Preparing a presentation described in subparagraph (1).
(3) Serving as a member of the Board or a member of a committee appointed by the Board or attending a meeting of the Board.
(4) Serving as a member of a board or committee relating to the practice of structural integration.
2. A structural integration practitioner may receive credit only once for giving or preparing a presentation described in subparagraph (1) of paragraph (c) of subsection 1.
3. The Board will consider the written request of a structural integration practitioner for approval of credit for any continuing education that is not specified in subsection 1, including credit for any continuing education that is not specifically related to structural integration, if the request is submitted to the Board at least 90 days before the date on which the license of the structural integration practitioner expires.

NAC 640C.115 Reflexologists: Requirements to maintain license; request to carry over excess hours of credit; notice of noncompliance. (NRS 640C.320, 640C.500)
1. To maintain his or her license to practice reflexology, a reflexologist must complete, to the satisfaction of the Board, at least 12 hours of instruction in continuing education as specified in NAC 640C.117 within the licensing period immediately preceding the request for renewal of his or her license. Except as otherwise provided in subsection 2, proof of the completion of the requirement for continuing education must be submitted with an application for renewal of a license.
2. If a reflexologist obtains more than 12 hours of instruction in continuing education in a licensing period, the reflexologist may request that the Board carry over the excess hours of credit, not to exceed 36 hours of instruction, to apply towards completion of the requirement for continuing education set forth in subsection 1 for succeeding years, up to a maximum of 3 succeeding years.
3. If a reflexologist fails to complete the requirements for continuing education set forth in subsection 1 before the date on which his or her license expires, the Board will send a notice to the reflexologist indicating that the reflexologist is not in compliance with the requirements for continuing education.

NAC 640C.117 Reflexologists: Approval of credits by Board. (NRS 640C.320, 640C.500)
1. The Board will approve credit for continuing education for a license to practice reflexology as follows:
(a) One hour of credit will be approved for each hour of instruction that a reflexologist attends a workshop, course, conference or seminar relating to the practice of reflexology which is provided by a person or entity that is:
(1) Accredited by the National Commission for Certifying Agencies, or an equivalent accrediting body approved or recognized by the Board;
(2) Approved by the American Reflexology Certification Board;
(3) A reflexology school, massage therapy school, bodywork therapy school, public college, postsecondary institution or other entity which offers a program of reflexology that is recognized by the Board pursuant to NRS 640C.600 and NAC 640C.060; or
(4) A reflexologist with at least 2 years of experience in the practice of reflexology who is certified by the American Reflexology Certification Board, International Institute of Reflexology or National Certification Board for Therapeutic Massage and Bodywork or who has experience in a related field and has previously received approval from the Board for the workshop, course, conference or seminar.
(b) The amount of credit for authoring a publication relating to the practice of reflexology will be determined upon receipt and evaluation by the Board of the information required to be submitted pursuant to NAC 640C.130.
(c) One hour of credit, up to a maximum of 16 hours of credit per renewal period for each activity listed in subparagraphs (1), (2) and (3), will be approved for each hour of instruction spent:
(1) Giving a presentation at a workshop, course, conference or seminar relating to the practice of reflexology.
(2) Preparing a presentation described in subparagraph (1).
(3) Serving as a member of the Board or a member of a committee appointed by the Board or attending a meeting of the Board.
2. A reflexologist may receive credit only once for giving or preparing a presentation described in subparagraph (1) of paragraph (c) of subsection 1.
3. The Board will consider the written request of a reflexologist for approval of credit for any continuing education that is not specified in subsection 1, including credit for any continuing education that is not specifically related to reflexology, if the request is submitted to the Board at least 90 days before the date on which the license of the reflexologist expires.

NAC 640C.120 Massage therapists, reflexologists and structural integration practitioners: Request for approval of credit for attending, preparing or giving presentation; notice of approval or denial. (NRS 640C.320, 640C.500)
1. A massage therapist, reflexologist or structural integration practitioner may request approval of credit for continuing education from the Board before or after attending, preparing or giving a presentation at a program of continuing education.
2. A request made pursuant to subsection 1 must be accompanied by the applicable information and documentation listed in NAC 640C.130.
3. The Board will inform a massage therapist, reflexologist or structural integration practitioner of the approval or denial of credit for continuing education within 30 days after the next meeting of the Board immediately following the receipt of a request made pursuant to subsection 1.

NAC 640C.130 Massage therapists, reflexologists and structural integration practitioners: Information and documentation required to obtain credit. (NRS 640C.320, 640C.500)
1. To obtain credit for attending a program of continuing education relating to the practice of massage therapy, reflexology or structural integration, a massage therapist, reflexologist or structural integration practitioner must submit to the Board:
(a) The name of the program;
(b) The name of the sponsor of the program;
(c) Biographical information regarding the instructor of the program;
(d) The inclusive dates and location of attendance of the program;
(e) The number of hours awarded by the sponsor of the program for completion of the program;
(f) A certified or original copy of the signed certificate of completion; and
(g) A brief summary of the information that the massage therapist, reflexologist or structural integration practitioner learned at the program and the manner in which the massage therapist, reflexologist or structural integration practitioner will use that information in his or her practice.
2. To obtain credit for preparing or giving a presentation at a program of continuing education relating to the practice of massage therapy, reflexology or structural integration, a massage therapist, reflexologist or structural integration practitioner must submit to the Board:
(a) Biographical information regarding the massage therapist, reflexologist or structural integration practitioner who is preparing or giving the presentation at the program of continuing education;
(b) The title of the presentation;
(c) The name of the sponsor of the presentation;
(d) The location of the presentation;
(e) The number of hours of the presentation;
(f) The source of the information conveyed in the presentation;
(g) The inclusive dates of the presentation;
(h) A list of all the persons who attended the presentation; and
(i) A brief summary of the presentation and the information that a person who attended the presentation was expected to learn.
3. To obtain credit for authoring a publication relating to the practice of massage therapy, reflexology or structural integration, a massage therapist, reflexologist or structural integration practitioner must submit to the Board:
(a) A copy of the published material; and
(b) The title, publisher and date of publication of the published material.
4. Except as otherwise provided in subsection 5, if the credit for continuing education is for a course of study, training or performing an educational activity relating to the practice of massage therapy, reflexology or structural integration which is not specified in subsection 1 of NAC 640C.110, subsection 1 of NAC 640C.117 or subsection 1 of NAC 640C.112, as applicable, the massage therapist, reflexologist or structural integration practitioner must submit to the Board:
(a) A description of the subject matter studied, the training received or the educational activity performed;
(b) A schedule of the time spent studying, training or performing; and
(c) A brief summary of the manner in which the course, training or activity relates to massage therapy, reflexology or structural integration.
5. If the credit for continuing education is sought for:
(a) A course attended by telecommunication or on the Internet, the massage therapist, reflexologist or structural integration practitioner must submit to the Board a copy of the transcript and the certificate of completion or other proof of completion, which includes the contact information of the provider.
(b) Serving as a member of the Board or a member of a committee appointed by the Board or attending a meeting of the Board, the massage therapist, reflexologist or structural integration practitioner must submit to the Board a list of the dates on which the meetings were attended.

NAC 640C.140 Requirements for request of approval for course or program; notice of approval or denial. (NRS 640C.320)
1. To obtain approval for a course or program of continuing education, a presenter of the course or sponsor of the program of continuing education, other than a person or entity listed in subsection 1 of NAC 640C.110, must submit to the Board the following information concerning the course or program of continuing education, in addition to submitting the information set forth in subsection 2 of NAC 640C.130:
(a) The syllabus or outline for the course or program of continuing education; and
(b) The original draft of the certificate of completion that will be distributed to participants upon completion of the course or program of continuing education.
2. The Board will inform the presenter or sponsor of the approval or denial of credit for continuing education within 30 days after the next meeting of the Board immediately following the receipt of a request made pursuant to subsection 1.

Plc 305.02 Continuing Education Requirements.
(a) Licensees shall complete a minimum of 12 hours of continuing education during each licensing period in accordance with RSA 328-B:4, VII(j).
(b) Continuing education programs shall be:
(1) Sponsored by a professional association that specializes in massage education;
(2) Sponsored by a post-secondary institution;
(3) Instructed by a provider who has been approved by the National Certification Board for Therapeutic Massage and Bodywork; or
(4) Instructed by a provider who has been approved by the Federation of State Massage Therapy Boards.
(c) Home study programs shall include books, audio, video, or computer programs with passage of a written examination. (d) Subjects for continuing education supporting the scope of practice as described in RSA 328-B:2-a shall be limited to:(1) Anatomy;
(2) Physiology;
(3) Massage theory;
(4) Massage techniques;
(5) Benefits and contraindications of massage;
(6) Kinesiology;
(7) Hydrotherapy;
(8) Joint movement;
(9) Allied bodyworker techniques;
(10) Communicable disease control;
(11) Hygiene or sanitary practices;
(12) Ethical or legal aspects of massage practice; or
(13) Management, administration, or supervision of a business practice, which:
a. Relates directly to the operation of a massage therapy business;
b. Does not include instruction on computer skills; and
c. Is limited to 3 hours per licensing period.
(e) Hours spent teaching massage therapy shall count, on an hour per hour basis, towards the continuing education requirements of (a) above.
(f) Publication of books or peer-reviewed articles shall count, for a maximum of 6 hours per book or peer-reviewed article, towards the continuing education requirements of (a) above.
(g) Publication of other articles shall count, for a maximum of 3 hours per article, towards the continuing education requirements of (a) above.

Section 13:37A-4.2 – Continuing education programs(a) A licensee may obtain continuing education credit hours from the following:
- Successful completion of continuing education courses or programs related to the practice of massage and bodywork therapy, one credit hour for each hour of instruction. Courses and programs shall be approved by, or offered by providers approved by:i. NCBTMB;ii. NCCAOM;iii. The American Massage Therapy Association (AMTA);iv. The American Medical Association (AMA);xii. The Ida P. Rolf Research Foundation; orxiii. A state board of massage, massage and bodywork, physical therapy, or chiropractic;
- Teaching a new continuing education program related to massage and bodywork therapy that is approved pursuant to (a)1 or 2 above. As used in this paragraph, “new” means that the licensee has never taught or developed curriculum for that course or program in any educational setting; one credit hour for each hour taught;
- Authorship of a published textbook or a chapter of a textbook directly related to the practice of massage and bodywork therapy; four credit hours for each chapter up to 20 credit hours;
- Authorship of a published article, which has been referred through peer review, related to the practice of massage and bodywork therapy, in a medical or health related journal; four credit hours; and
- Presenting a new seminar or lecture to professional peers, provided the seminar or lecture is at least one hour long; as used in this paragraph, “new” means that the licensee has never presented the seminar or lecture before; one credit hour for each hour of presentation.

16.7.11.8 GENERAL PROVISIONS: The board does not maintain a list of continuing education providers. The licensee must determine where to obtain the required continuing education.
A. As a condition for license renewal, each massage therapist licensed pursuant to the Massage Therapy Practice Act must complete 16 hours of continuing education of which up to eight hours can be taken on-line.
(1) continuing education must be completed within the 24 months immediately preceding the renewal date of October 31;
(2) excess hours cannot be carried over to future renewals;
(3) continuing education taken prior to the 24 month period will not be accepted;
(4) each licensee will maintain documentation of all completed continuing education, including contact information for the provider of each course.
B. Audit process: The board will audit continuing education to verify compliance.
(1) a minimum of ten percent of renewing licensees will be randomly selected for audit;
(2) audit requests may be included in the renewal notice;
(3) licensees not selected for audit shall attest to the completion of continuing education for the current renewal cycle;
(4) the board may audit any licensee’s continuing education records at any time before the next scheduled license renewal;
(5) audited licensees who fail to provide the requested continuing education documentation are not eligible for license renewal.

16.7.11.9 CONTINUING EDUCATION REQUIREMENTS:
A. The board will accept, towards a licensee’s continuing education requirements, courses, seminars, workshops, or classes in an area related to the practice of massage therapy. This includes, but is not limited to:
(1) massage;
(2) bodywork;
(3) health care;
(4) psychology;
(5) anatomy and physiology;
(6) business;
(7) insurance;
(8) ethics;
(9) professional development;
(10) movement therapy;
(11) stress management; and
(12) exempt modalities as defined by Section 61-12C-5.1 NMSA 1978.
B. The board will also accept, towards a licensee’s continuing education requirements, a licensee’s publication of an article relating to massage therapy in a local, regional, or national publication. No more than 12 hours of continuing education credit shall be granted in any given renewal period for the publication of such an article. The number of continuing education hours shall be determined by the massage therapy board, provided that in the interim the board’s staff may grant the continuing education hours to then be ratified at the next regular meeting of the board.
C. All massage therapists shall be required to complete a minimum of four hours of ethics training as part of the 16-hour requirement for each renewal period.
D. All massage therapists shall be required to complete a minimum of eight hours of live, in-person training as part of the 16-hour requirement for each renewal period.
E. Continuing education courses are the responsibility of every massage therapy licensee, and it is the obligation of each licensee to comply with these rules. A licensee’s lack of knowledge as to whether a continuing education course was previously approved by the board will not be a valid justification or defense for a licensee’s failure to comply with continuing education requirements.

16.7.11.10 CONTINUING EDUCATION COURSES TAUGHT BY CONTINUING EDUCATION PROVIDERS:
A. The board will accept all courses offered by a continuing education provider, as defined in 16.7.1 NMAC and Section 61-12C-3 NMSA 1978, towards a licensee’s continuing education requirements regardless of the location at which the course is taught.
B. Any continuing education provider who was an active New Mexico registered independent massage therapy instructor on February 4, 2019, must provide both the course syllabus and the required fee for each new course not previously approved by the board prior to such course being counted towards a licensee’s continuing education requirements. This is a one-time requirement per continuing education course.
C. A course taught by a continuing education provider, as defined in Subsection 7 of 16.7.1 NMAC who was not an active New Mexico registered independent massage therapy instructor on February 4, 2019, does not require prior approval by the board before being counted towards a licensee’s continuing education requirements.

16.7.11.11 OTHER CONTINUING EDUCATION COURSES:
A. Applicants seeking the board’s approval of other continuing education courses must submit the following documentation to the board:
(1) completed application form;
(2) course syllabus for the proposed course;
(3) copy of any license, registration, or certification applicable to the course, if offered by the applicant’s home jurisdiction;
(4) proof of a minimum of two years’ experience in the area of instruction;
(5) applicant’s up-to-date resume;
(6) fee as outlined by 16.7.3.8 NMAC.
B. Technique courses will only be accepted towards a licensee’s continuing education requirements if taught hands-on and live, in-person.
C. Provided that the applicant has submitted a complete application, the board will approve or deny the course’s use towards a licensee’s continuing application requirements based on the following non-exhaustive factors:
(1) whether the applicant has violated any of the board’s rules or the Massage Therapy Practice Act;
(2) whether the applicant has any recent administrative disciplinary history in New Mexico or any other jurisdiction;
(3) whether the applicant was dishonest in his or her application, or has a history of criminal offenses that substantially relate to the practice of massage therapy or a failure to pay child support; and
(4) any other factor deemed relevant by the board.
D. Upon receipt of a complete application, the board’s staff shall, with the consultation of the board’s application committee, make a preliminary and tentative recommendation as to whether the application should be approved or denied. This recommendation will be conveyed to the applicant in writing within 30 days of the board’s receipt of the completed application. The final decision will be made by the board at its next regularly-scheduled meeting.
E. In the event that the board’s staff tentatively recommends the denial of an application, the applicant may request in writing the opportunity to be heard at the next regularly-scheduled board meeting. Where the applicant has made a request to be heard and the board votes to deny the application, the board will issue a final written decision no later than 15 business days following the board’s meeting.

§ 78.5 Continuing education for massage therapists*.
*Effective January 1, 2012
a. Definitions. As used in this section:
- Acceptable accrediting agency means an organization accepted by the Department as a reliable authority for the purpose of accreditation at the postsecondary level, applying its criteria for granting accreditation in a fair, consistent and nondiscriminatory manner, such as an agency recognized for this purpose by the Council for Higher Education Accreditation.
- Higher education institution means a degree-granting postsecondary institution registered by the Department or accredited by an acceptable accrediting agency.
b. Applicability of requirement. - Each licensed massage therapist, required under Article 155 of the Education Law to register with the Department to practice in New York State, shall comply with the mandatory continuing education requirements as prescribed in subdivision (c) of this section, except those licensees exempt from the requirement or who obtain an adjustment to the requirement pursuant to paragraph (2) of this subdivision or who are subject to a different requirement pursuant to this section.
- Exemptions and adjustments to the requirement.
i. Exemptions. The following licensees shall be exempt from the continuing education requirements, as prescribed in subdivision (c) of this section:
a. licensees for the triennial registration period during which they are first licensed to practice as a massage therapist in New York State; and
b. licensed massage therapists who are not engaged in the practice of massage therapy, as evidenced by not being registered to practice in New York State, except as otherwise prescribed in subdivision (e) of this section to meet the requirements for the resumption of practice in New York State.
ii. Adjustments to the requirement. An adjustment to the continuing education requirement, as prescribed in subdivision (c) of this section, may be made by the Department, provided that the licensee documents good cause that prevents compliance or the Department determines otherwise that there is good cause that prevents compliance, which shall include, but not be limited to, any of the following reasons: poor health or a specific physical or mental disability certified by an appropriate health care professional; or extended active duty with the Armed Forces of the United States; or other good cause beyond the licensee’s control which in the judgment of the Department, makes it impossible for the licensee to comply with the continuing education requirements in a timely manner.
c. Mandatory continuing education requirement. - General requirement.
i. During each triennial registration period, meaning a registration period of three years’ duration, an applicant for registration shall complete at least 36 hours of continuing education, acceptable to the Department, as defined in paragraph (2) of this subdivision, a maximum of 12 hours of which may be self-instructional coursework acceptable to the Department. Any licensed massage therapist whose first registration date following January 1, 2012 occurs less than three years from that date, shall complete continuing education hours on a prorated basis at the rate of one hour of acceptable formal continuing education per month for each full calendar month completed between January 1, 2012 and the licensee’s first registration date thereafter. Such continuing education shall be completed during the period beginning January 1, 2012 and ending before the first day of the new registration period.
ii. Proration. Unless otherwise prescribed in this section, during each registration period of less than three years’ duration, an applicant for registration shall complete acceptable continuing education, as defined in paragraph (2) of this subdivision and within the limits prescribed in such paragraph, on a prorated basis at a rate of one hour of continuing education per month for such registration period. - Acceptable formal continuing education. To be acceptable to the Department, continuing education shall meet the requirements of this paragraph. Such continuing education must be coursework in subjects prescribed in subparagraph (i) of this paragraph and be the types of learning activities prescribed in subparagraph (ii) of this paragraph and subject to the prohibition contained in subparagraph (iii) of this paragraph.
i. Subjects. Acceptable continuing education shall be coursework that contributes to the professional practice of massage therapy and shall have as its focus one or more of the following content areas, provided, however, that any coursework including the practical application of modalities or techniques shall only be accepted if such coursework provides instruction on the application of modalities or techniques legally authorized to be practiced within the scope of practice of massage therapy:
a. Subjects that enhance knowledge and skill in the theory, technique, and methods that fall within or are related to the practice of massage therapy, including, but not limited to, instruction in Swedish massage; medical massage; Shiatsu; connective tissue massage; Tui Na; reflexology; acupressure; polarity; myofascial massage; neuromuscular massage; craniosacral techniques; manual lymphatic drainage; infant massage; pregnancy massage; stretching; exercises to facilitate, enhance or perpetuate the benefits of massage therapy; Thai massage; sports massage; and courses related to specific physical conditions, such as cancer, that may require massage therapy;
b. Subjects that are fundamental to the practice of the profession, including, but not limited to, pathology, myology, neurology, anatomy, physiology, or subjects that are ancillary to the practice, such as effects of massage therapy on medication regimes;
c. Subjects that include, but not limited to, activities and skills needed for practice, such as communication, intake procedures, assessment and evaluation, treatment planning, prevention, recordkeeping, First Aid, CPR, and knowledge of the chemical ingredients and safety of products and tools used in the practice of massage therapy;
d. Clinical interventions/evidence-based models;
e. Philosophy and principles of massage therapy;
f. Subjects relating to health care, professional rules and regulations, standards of good practice, precautions, law, and/or ethics which contribute to professional practice in massage therapy and the health, safety, and/or welfare of the public.
ii. Types of learning activities. Acceptable continuing education shall be the types of learning activities prescribed in this subparagraph and shall be subject to the limitations prescribed in this subparagraph and subparagraph (iii) of this paragraph.
a. Courses of learning. Acceptable continuing education may be courses of learning offered by a sponsor, approved by the Department pursuant to subdivision (i) of this section, which may include, but need not be limited to, courses offered by such an approved sponsor; university and college credit and non-credit courses; or courses offered by programs registered by the Department as licensure-qualifying for the profession of massage therapy. Acceptable formal classes may be presented in various modes of instruction, including distance learning, but massage therapists must have documentation acceptable to the Department, verifying his or her completion of the coursework and detailing the duration and content of the course;
b. Other educational activities. Acceptable continuing education shall include the following other educational activities: - preparing and teaching a course offered by a sponsor of continuing education to massage therapists, approved pursuant to subdivision (i) of this section, provided that such teaching shall not be acceptable where the licensee has taught the course on more than one occasion without presenting new or revised material. Continuing education hours that may be credited for this activity may include actual instructional time plus preparation time which may be up to two additional hours for each hour of presentation;
- preparing and teaching a course acceptable to the Department, at a higher education institution or at a program registered by the Department as licensure-qualifying for the profession of massage therapy and relating to the practice of massage therapy, provided that such teaching shall not be acceptable where the licensee has taught the course on more than one occasion without presenting new or revised material. Continuing education hours that may be credited for this activity may include actual instructional time plus preparation time which may be up to two additional hours for each hour of presentation;
- making a presentation at a professional conference sponsored by an organization that is a sponsor of continuing education to massage therapists and that is approved pursuant to subdivision (i) of this section, provided that such presentation shall not be acceptable where the licensee has presented on the topic on more than one occasion without presenting new or revised material. Continuing education hours that may be credited for this activity shall include actual presentation time, plus preparation time which may be up to two additional hours for each hour of presentation;
- authoring an article or report of research published in a peer-reviewed journal or a published book, provided that the amount of continuing education credit awarded for such activity shall be an amount prescribed by the Department;
- renewing a course in First Aid or CPR leading to a certificate for a maximum of three hours in each renewal period for each subject;
- completion of an online test, developed by the State Board for Massage Therapy and the Department, on ethics, precautions, standards of practice, and the Rules of the Board of Regents and the Regulations of the Commissioner of the Commissioner of Education relating to the practice of massage therapy for a maximum of three hours;
- achieving a specialty certification or recertification from an entity acceptable to the Department, provided that the amount of continuing education credit awarded for such certification or recertification shall be an amount prescribed by the Department;
- completing a self-study program, meaning structured study, provided by a sponsor approved pursuant to subdivision (i) of this section, that is based on audio, audio-visual, written, on-line, and other media, and does not include live instruction, transmitted in person or otherwise, during which the student may communicate and interact with the instructor and other students; or
- completing a maximum of 12 hours of self-instructional coursework to meet the continuing education requirement, including, but not limited to, online coursework in any of the areas identified in subparagraph (i) of paragraph (2) of this subdivision, to the extent that the content of such coursework and hours completed can be verified by documentation. A maximum of six hours of study in online courses that have been approved by other jurisdictions for formal education in massage therapy, including continuing education may be included in such self-instructional coursework.
iii. Prohibition. - Any continuing education designed for the sole purpose of maximizing profits for the practice of a massage therapist shall not be acceptable as continuing education.
- Coursework in techniques that do not fall in the practice of the profession of massage therapy, such as, but not limited to, Reiki, Feldenkrais Method, the Alexander Technique, or appearance enhancement practices as defined by the New York State Department of State shall not be acceptable as continuing education.

§ 7807. Mandatory continuing education.
[Became law August 30, 2010; effective, January 1, 2012]
- a. Each massage therapist licensed pursuant to this article required to register triennially with the department to practice in the state shall comply with the provisions of the mandatory continuing education requirements prescribed in subdivision two of this section except as set forth in paragraphs (b) and (c) of this subdivision. Massage therapists who do not satisfy the mandatory continuing education requirements shall not practice until they have met such requirements, and they have been issued a registration certificate, except that a massage therapist may practice without having met such requirements if he or she is issued a conditional registration certificate pursuant to subdivision three of this section.
b. Massage therapists shall be exempt from the mandatory continuing education requirement for the triennial registration period during which they are first licensed. In accord with the intent of this section, adjustments to the mandatory continuing education requirement may be granted by the department for reasons of health certified by an appropriate health care professional, for extended active duty with the armed forces of the United States, or for other good cause acceptable to the department which may prevent compliance.
c. A licensed massage therapist not engaged in professional practice, as determined by the department, shall be exempt from the mandatory continuing education requirement upon the filing of a statement with the department declaring such status. Any licensee who returns to the practice of massage therapy during the triennial registration period shall notify the department prior to reentering the profession and shall meet such mandatory education requirements as shall be prescribed by regulations of the commissioner. - During each triennial registration period an applicant for registration as a massage therapist shall complete a minimum of thirty-six hours of acceptable formal continuing education, a maximum of twelve hours of which may be self-instructional course work acceptable to the department. Any massage therapist whose first registration date following the effective date of this section occurs less than three years from such effective date, shall complete continuing education hours on a prorated basis at the rate of one hour per month for the period beginning January first, two thousand twelve up to the first registration date thereafter. A licensee who has not satisfied the mandatory continuing education requirements shall not be issued a triennial registration certificate by the department and shall not practice unless and until a conditional registration certificate is issued as provided for in subdivision three of this section, or until he or she has otherwise met the requirements of this section.
- The department, in its discretion, may issue a conditional registration to a licensee who fails to meet the continuing education requirements established in subdivision two of this section but who agrees to make up any deficiencies and complete any additional education which the department may require. The fee for such a conditional registration shall be the same as, and in addition to, the fee for the triennial registration. The duration of such conditional registration shall be determined by the department but shall not exceed one year. Any licensee who is notified of the denial of registration for failure to submit evidence, satisfactory to the department, of required continuing education and who practices without such registration, may be subject to disciplinary proceedings pursuant to section sixty-five hundred ten of this chapter.
- As used in subdivision two of this section, “acceptable formal continuing education” may mean formal programs of learning which contribute to professional practice in massage therapy which are offered by sponsors of massage therapy continuing education approved by the department in consultation with the state board for massage therapy, to fulfill the mandatory continuing education requirement. Sponsors of massage therapy continuing education may include, but are not limited to, state or national professional associations established to further the massage therapy profession, and may include any affiliates of international massage therapy conferences at which professional continuing education is a major component of such conferences, as well as programs registered as licensure-qualifying for the profession of massage therapy by the department. Sponsors of massage therapy shall file an application with the department and pay a fee of nine hundred dollars. While presenters of didactic instruction may be provided by persons who are not licensed by the state of New York as massage therapists, the practical application of such modalities and techniques must be done by licensed massage therapists, or those otherwise authorized, when this continuing education occurs in the state of New York.
- Massage therapists shall maintain adequate documentation of completion of acceptable formal continuing education and shall provide such documentation at the request of the department. Failure to provide such documentation upon the request of the department shall be an act of misconduct subject to disciplinary proceedings pursuant to section sixty-five hundred ten of this chapter.
- The mandatory continuing education fee shall be forty-five dollars, shall be payable on or before the first day of each triennial registration period, and shall be paid in addition to the triennial registration fee required by section seventy-one hundred twenty-four of this chapter.

SECTION .0700 – CONTINUING EDUCATION .0701 CONTINUING EDUCATION REQUIREMENTS (a) For the purposes of this Section, “approved continuing education” means a course offered as follows: (1) Continuing Education:
(A) Includes attendance and participation at a live presentation by an approved provider pursuant to Rule .0702(7) of this Chapter such as a workshop, seminar, Board of Massage & Bodywork Therapy conference, or in-service educational program. It may also include participation in other continuing education activities that require a formal assessment of learning, such as an evaluation or survey. Examples include distance learning, electronic, or Web-based courses;
(B) There are no maximum contact hours in this category; however, distance learning shall not comprise more than 12 contact hours in this category; and
(C) Documentation shall include a certificate of completion or similar documentation including the name of the course, date, author/instructor, sponsoring organization, location, and number of contact hours attended.
(2) Academic Coursework: (A) Includes participation in on-site or distance learning academic courses from a university, college, or vocational technical adult education course in anatomy, physiology, pathology, psychology, pharmacology, massage and bodywork therapy or business management; (B) There are no maximum contact hours in this category; and (C) Documentation shall include an original transcript indicating completion of the course, date, and a description of the course from the school catalogue or course syllabus.
(3) Small Group Study: (A) Includes on-site, in-person review and discussion, by at least two licensed practitioners, of professional medical journal articles, clinical videotapes or audiotapes related to the practice of massage and bodywork therapy; (B) There is a maximum of two contact hours in this category; and (C) Documentation shall include title, author, publisher, time spent, and date of completion. The licensee shall complete the Small Group Study Form provided by the Board on its website at www.bmbt.org and include a statement that describes how the review and discussion relates to the licensee’s current or anticipated roles and responsibilities.
(4) Mentorship Agreement: (A) Participation as a Mentee; (i) Participation in a formalized mentorship agreement with a mentor currently licensed by the Board with at least two years of professional experience and as defined by a signed contract between the mentor and mentee provided by or approved by the Board that outlines goals and objectives and designates the plan of activities that are to be met by the mentee. These activities must be related to massage and bodywork therapy skills, knowledge, or practice; Board of Massage & Bodywork Therapy (ii) There is a maximum of five contact hours in this category; and (iii) Documentation shall include name of mentor and mentee, copy of signed contract, dates, hours spent and focus of mentorship activities, and outcomes of mentorship agreement. (B) Participation as Mentor: (i) Participation in a formalized mentorship agreement with a mentee as defined by a signed contract between the mentor and mentee that designates the responsibilities of the mentor and goals and objectives that are to be met by the mentee. These activities must be related to massage and bodywork therapy skills, knowledge, or practice; (ii) There is a maximum of five contact hours in this category; and (iii) Documentation shall include name of mentor and mentee, copy of signed contract, dates, hours spent and focus of mentorship activities, and outcomes of mentorship agreement. (
5) Professional Writing: (A) Publication or written acceptance for publication of a book, chapter, or article evaluated by experts in and related to massage and bodywork therapy; (B) During the year written or edited a licensee may earn; (i) 15 contact hours as author of a book; (ii) 10 contact hours as author of a chapter; (iii) Five contact hours as author of an article; or (iv) Five contact hours as listed editor of a book. (C) Documentation shall consist of full reference for publication including title, author, editor, and date of publication; or copy of acceptance letter, if not yet published; and (D) Credit for submitted items shall be given for one licensure period only.
(6) Presentation and Instruction: (A) Presentation for the first time of an academic course, workshop, or seminar related to massage and bodywork therapy; (B) There is a maximum of five contact hours in this category; and (C) Documentation shall include a syllabus and the date and hours of presentation.
(7) Professional Meetings and Activities: (A) Consistent with Rule .0703 of this Section, participation in board or committee work with agencies or organizations to promote and enhance the practice of massage and bodywork therapy; (B) There is a maximum of five contact hours in this category; and Page 42 Rules and Regulations • Board of Massage & Bodywork Therapy (C) Documentation shall include the name of the committee or board, the name of the agency or organization, purpose of service, and description of licensee’s role. Participation and hours shall be documented in writing by an officer or representative of the organization or committee.
(8) Research and Grants: (A) Development of or participation in a research project or grant proposal related to massage and bodywork therapy; (B) A licensee may earn one contact hour for each three hours spent working on a research project or grant proposal. There is a maximum of five contact hours in this category; and (C) Documentation includes verification stating the name of the research project, dates of participation, major hypotheses or objectives of the project, and licensee’s role in the project or name of grant proposal, name of grant source, purpose and objectives of the project, and verification from the grant author regarding licensee’s role in the development of the grant if the licensee is not the author. (b) Distance learning, as defined in Rule .0702 of this Section, shall not comprise more than 12 hours of the required continuing education hours per licensure period. (c) Licensees shall document that they have completed at least three contact hours of continuing education in professional ethics as defined in Rule .0702 of this Section, out of the minimum of 24 hours of approved continuing education required for license renewal. This may be obtained through supervised classroom instruction or distance learning. (d) Business management, as defined in Rule .0702 of this Section, shall not comprise more than eight hours of the minimum 24 hours of approved continuing education required for license renewal. (e) Licensees shall ensure that each continuing education course for which they claim credit on their application for renewal of licensure complies with this Section. (f) The Board shall audit licensees at random to assure compliance with these requirements.
.0702 CONTINUING EDUCATION DEFINITIONS The following definitions apply to this Section:
(1) Continuing education — Learning experiences that develop, maintain, enhance, and expand the performance skills, interpersonal abilities, critical reasoning skills, ethical reasoning skills, knowledge, and attitudes of massage and bodywork therapists that enable them to render competent professional service to clients, the profession, and the public.
(2) Distance learning — Courses taken by home study that are produced by an approved provider, whether delivered by videotape, audiotape, printed materials, or computer- Page 43 Rules and Regulations • Board of Massage & Bodywork Therapy based means. The licensee shall demonstrate achievement of learning objectives and completion of course requirements to the provider before credit is given.
(3) One “contact hour” of continuing education — At least 50 minutes of any one clock hour during which the student participates in a learning activity in the physical presence of an instructor, or in a distance learning activity designed by an approved provider. One semester credit hour at a post-secondary institution shall be equivalent to 21 contact hours.
(4) Professional ethics — A system of conduct guided by principles that are intended to ensure the safe and effective practice of massage and bodywork therapy. Acceptable subject matter for required professional ethics courses may include: compliance with the Practice Act and Rules of the Board, management of the client/therapist relationship, boundary functions, professional communication skills, conflict resolution, cultural diversity issues, and standards of practice.
(5) Business management — Courses that enable licensees to learn business skills to apply to their practice.
(6) Post secondary institution of higher learning – A degree granting institution accredited by an accrediting agency recognized by the United States Department of Education.
(7) Approved provider — One that has been approved by any entity with which the Board has reached a contractual agreement for the approval of continuing education providers and courses. A list of accrediting entities with which the Board has entered into a contractual agreement is available on the Board’s website at www.bmbt.org. The provider shall have this designation when the course begins and shall maintain this designation continuously until the course is completed. The Board shall not recognize any retroactive designation of provider approval. The provider shall follow all regulations set forth by its accrediting agency. The Board may also recognize a continuing education provider outside the United States or its territories that is a post-secondary institution of higher learning approved by the educational regulation authority of that foreign country.
.0703 SCOPE OF QUALIFIED ACTIVITIES FOR MAINTAINING CONTINUING EDUCATION (a) To be approved by the Board, continuing education activities shall be related to roles and responsibilities in massage and bodywork therapy and serve to protect the public by enhancing the licensee’s continuing competence. (b) Subject matter for approved activities include: (1) research; (2) theoretical or practical content related to the practice of massage and bodywork therapy; or Page 44 Rules and Regulations • Board of Massage & Bodywork Therapy (3) the development, administration, supervision, and teaching of clinical practice or service delivery programs by massage and bodywork therapists.
.0704 WAIVER OF CONTINUING EDUCATION REQUIREMENTS DURING DISASTER OR EMERGENCY (a) If the Governor declares a state of emergency, the Board may allow all continuing education hours required by G.S. 90-630.5 and Rule .0701(b) of this Chapter to be obtained by distance learning. In making this determination, the Board shall consider the risk of harm to licensed massage and bodywork therapists attending in-classroom continuing education courses. (b) The exceptions in this Rule shall only apply during the effective period of the state of emergency

Guidelines for Acceptable CE
Acceptable forms of CE courses:
- Contact application: (may be referred to as face to face /on location course):
• A course presentation that takes place in a physical setting with an attending provider physically present during the entire process. Attendees interact by verbal communication and/or physical touch (practical learning) to other attendees while the instructor/provider and/or their associates supervise.
• 12 continuing education hours are required by law to be hands-on muscle manipulation therapies and given in the physical presence of the class instructor/presenter. - Remote application:
• Of the 24 required hours, up to 10 hours can be by remote means and may include: Webinar /Podcasts that are not live-feed; DVD with written materials and student feedback.
Appropriate course content:
• Application of general massage techniques as defined by NDCC 43-25 and ND Admin Code Title 49.
• Massage business related topics. The LMT must submit an explanation on how this relates to massage.
• Ethics: Patient/therapist boundaries, therapist confidentiality, courses offering an insight for specific needs of clientele (vulnerable populations)
• Stretching as defined in NDCC 43-25-02(2a-3).
• Courses outlining contraindications for massage therapy
• Communicable diseases; prevention/infection control
• Specialty training as pertaining to massage therapy: Diabetes, Cancer, Fibromyalgia, PTSD and other diagnosed illnesses that can be alleviated with massage.
• Courses relating to massage therapy research – at board discretion
• First aid training/recertification accredited by American Red Cross and/or American Heart Association
• Cardiac Pulmonary Resuscitation initial course and refresher courses
Course content possibly considered by the Board (no guarantee of approval):
• College course(s):
o Must provide a transcript showing course completion and passing grade. Transcript must show that class was taken within the two years prior to initial/renewal of licensing.
o Must provide a course syllabus with detailed explanation of how course pertains to massage therapy.
o Board review is required before approval. The decision is dependent on the course material submitted to the board.
• Hours obtained while completing allopathic medical programs will not be considered for massage continuing education as it is out of scope of practice as per NDCC 43-25. The board may grant hours as determined by the board for first aid and/or cardiac pulmonary resuscitation (CPR) if offered during the program. Transcript and certification card is required for approval.
Non-acceptable course content, includes but is not limited to:
• Diagnoses of clinical conditions
• Implementation of allopathic medical/surgical procedures
• Physically invasive modalities, e.g., ear candling, intra-anal, intra-vaginal modalities, etc…
• Incorporation of chiropractic/osteopathic, e.g., ballistic, thrust oriented.
• Services and procedures which require additional licensure or certification outside massage therapy scope of practice.
• Prescription of herbs, nutritional supplements, and/or pharmaceuticals
• Performing hypnosis
• Performing esthetician procedures/modalities
• The use of electrical stimulation, electrical devices, or ultrasound
• Psychological counseling
• Psychic, clairvoyance, telepathic, astrology, religious practices
• Modalities where the skin is pierced, cut, or penetrated – ie. dry needling, acupuncture, breaking or removing tissue from the body
• Massage on non-human life forms
• Other course material the board deems unacceptable

Licensed/actively practicing up to 14 years:
*For the FIRST LICENSE RENEWAL after becoming licensed in the State of North Dakota, you are not required to obtain continuing education hours. The second license renewal after becoming licensed in the State of North Dakota, you will be required to obtain 24 continuing education hours including a minimum of 3 hours in Ethics education. Thereafter, 24 hours of continuing education are required with ethics education optional. Of the 24 hours, 12 hours must be classroom, hands-on.
